asbestos means the fibrous form of mineral silicates belonging to the serpentine and amphibole groups of rock forming minerals and includes actinolite, amosite (brown asbestos), anthophyllite, crocidolite (blue asbestos), chrysotile (white asbestos), tremolite and any substance containing one or more of these.
Sections 55 to 59 of the Workplace Health and Safety Act outline the duty of care that various people
including employers, workers, occupiers, owners and self employed
persons have to ensure that workplaces are safe and without
risk to the health or safety of the workers and any other
person who may be affected by the work being carried out.
Workplace can include private dwellings if a worker or contractor
is employed to do work there.
The Workplace Health and Safety Regulations have specific requirements that must be complied with when
working with asbestos.
Regulation 151 requires that before a building or structure
is demolished the person carrying out the demolition shall
(a) examine the building or structure to determine whether asbestos
is present in the building or structure; and (b) ensure that,
if asbestos is present, it is removed in accordance with these
Regulations.
Regulations 158 to 164 outlines the specific requirements
that must be complied with when working with asbestos.
Regulation 15 - Licence required to perform certain work - calls up Schedule 3 and details the type of work involving the removal of asbestos that requires a licence.
